UPDATE: Export Controls Reform Initiative
President Obama announced in 2010 that a new Export Controls Initiative Program was going to be devised to increase enforcement of export controls regulations and to streamline the export controls program. The Plan is still undergoing development with committee hearings and reports being presented on the reform plans. There is the upcoming Conference on Export Controls and Policy being held July 19-21, 2011 in Washington to discuss the implementation of export control reforms. New ITAR rules will go into effect on August 15, 2011. Michael Hoffman, the Director of the Western Regional Office of Bureau of Industry and Security leads the BIS efforts on the West Coast for U.S. national, security, foreign policy, and nonproliferation based trade regulations and policies. |

The World Trade Organization, the international trade and agreements body established in 1995, and the administering arm of GATT, maintains the first 6 digits of the Harmonized Code, handles trade disputes, negotiates trade agreements, monitors trade policy, and provides guidelines for member countries regarding international trade. The Technical Committee on Customs Valuation meets twice per year. Todd R. Smith is a frequent guest speaker and attendee at these events. Mr. Smith is a member of the OECD/WCO Joint Focus Group on Transfer Pricing, and most recently spoke on the nexus between tax and customs related party pricing. Antidumping and Countervailing Duties 101
Did you know that Customs and Border Protection have made Antidumping and Countervailing Duties a Priority Trade Issue? When the Department of Commerce finds that imported merchandise was sold in the U.S. at an unfairly low or subsidized price, CBP is responsible for collecting the antidumping and countervailing duties timely to level the playing field for U.S. companies injured by these unfair trade practices. The goal of the CBP is to detect and deter circumvention of the antidumping and countervailing duties law and to liquidate final duties timely and accurately, while facilitating legitimate trade. |

INCOTERMS 2011 Defining Responsibilities in Your Transactions
The International Chamber of Commerce introduced INCOTERMS in 1937 to assist companies in structuring commercial transactions. The terms were designed to assist commercial agreements in critical areas like: Insurance, Transfer of Risk, Division of Cost, Routing of Cargo. The latest update to incoterms was in September 2010. |

Customs and Border Protection Laboratory Tour
We are pleased to have arranged for our members a group tour of the U.S. Customs and Border Protection (CBP) Los Angeles Laboratory. The tour of the laboratory has been a highlight in our past annual port tours. We believe it is valuable for our members to have the opportunity to see the examination of products, from food to footwear to toys, and learn how CBP is able to determine country of origin, classification, and other issues. CBP will also discuss gray market goods, counterfeits and seizures.

WITOC is pleased to have Bonnie Lemert, Assistant Port Director, Trade Operations, U.S. Customs and Border Protection (CBP), Los Angeles/Long Beach Seaport, attend our monthly meeting as a luncheon speaker to share topics of interest to the international trade community, highlighting CBP’s LA/LB Seaport’s activities and priorities. Ms. Lemert will provide an update on CBP trade enforcement activities, priorities, and partnerships with the trade. She will also address some of the CBP processes that help meet the demands of the trade community, and highlight some of CBP’s accomplishments and challenges faced by both CBP and the trade in the current Fiscal Year. These are eventful times at the Port with many things going on and you will not want to miss hearing from Ms. Lemert.
In these tough economic times, when every company is looking to maximize its bottom line, “duty drawback” has again gained significant interest. Drawback presents an opportunity to recover import duties, taxes and fees paid to U.S. Customs and Border Protection (CBP). “Drawback Simplification” is on the horizon and will open new doors of financial opportunity to many companies which currently file for drawback refunds, and those that have not yet explored the possibilities.
